Terms of Service

1. Introduction and acceptance
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," "your") and VIGILANT FRONT, S.L., trading as North ("North," "we," "us," "our"), governing your use of the North web application, mobile application, and all related services (collectively, the "Service").
By creating an account or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Notice. If you do not agree, you must not use the Service.
We may update these Terms from time to time. We will notify you of material changes at least 14 days in advance via email or in-app notification. Continued use after the effective date constitutes acceptance. If you disagree with any changes, your sole remedy is to stop using the Service and delete your account.
2. Description of the Service
North is a personal informational platform that helps you track habits, set goals, and monitor longevity-related fitness metrics. The Service includes:
- Habit and goal tracking: Create habits with daily or weekly cadences, set goals with milestones, and track your progress over time.
- Data source integrations: Optionally connect third-party services (currently Garmin, Strava, and Apple Health) to import activity, health, and fitness data.
- Longevity scoring: Derived metrics across six dimensions (cardiorespiratory fitness, strength, stability, sleep quality, body composition, movement) based on your connected data.
- Analytics and insights: Training load analysis, statistical associations, self-comparison, and weekly targets.
- AI-powered summaries: Automated weekly synthesis reports generated using third-party AI (Anthropic Claude), available to Premium subscribers.
- Social features: Challenges with other users, shareable achievement cards, and a referral programme.
The Service is provided on an "as is" and "as available" basis. Features may be added, modified, or removed as we continue to develop the platform. We will use reasonable efforts to notify you of significant changes.
3. NOT MEDICAL ADVICE — IMPORTANT DISCLAIMER
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
3.1 North is not a medical device or health service
The Service is a personal informational tool only. North is not a medical device, is not registered or approved by any health regulatory authority (including but not limited to the FDA, EMA, or any EU notified body under the Medical Device Regulation (EU) 2017/745), and is not intended to diagnose, treat, cure, mitigate, or prevent any disease or health condition.
3.2 Informational outputs only
All outputs of the Service — including but not limited to longevity scores, training load metrics, recovery indicators, capacity estimates, statistical associations, weekly targets, dimension scores, AI-generated summaries, and any other computed or derived data — are informational in nature and are provided for general wellness and self-tracking purposes only. They are based on heuristic models, statistical approximations, and limited data inputs that may not accurately reflect your individual health status, fitness level, or medical condition.
3.3 Not a substitute for professional advice
The Service does not provide medical advice, clinical guidance, exercise prescriptions, dietary recommendations, or any form of professional healthcare advice. You must not rely on any information provided by the Service as a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions regarding a medical condition or before starting, changing, or stopping any exercise, diet, or health regimen.
3.4 AI-generated content
The AI-powered weekly synthesis and other AI-generated content within the Service are produced by automated systems (currently Anthropic Claude). These outputs may contain inaccuracies, omissions, or inappropriate suggestions. AI-generated content does not constitute professional advice of any kind. You acknowledge that AI systems have inherent limitations and that you use AI-generated content at your own risk.
3.5 Assumption of risk
You expressly acknowledge and agree that your use of the Service and any reliance on its outputs is at your sole risk. You are solely responsible for any decisions you make based on information provided by the Service, including decisions relating to exercise, training, recovery, nutrition, or any other health-related activity. If you experience any adverse health event, seek immediate medical attention.
3.6 Emergency situations
The Service is not designed for and must not be used in emergency or time-critical health situations. If you believe you are experiencing a medical emergency, call your local emergency services immediately. Do not use the Service to assess or respond to an emergency.
4. Eligibility and account registration
- You must be at least 16 years old (or the age of digital consent in your jurisdiction, whichever is higher) to create an account and use the Service.
- You must provide accurate and complete registration information and keep it up to date.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
- You must notify us immediately at privacy@gonorth.it if you suspect unauthorised access to your account.
- Each person may maintain only one account. Accounts are non-transferable.
5. Subscription tiers and payments
5.1 Service tiers
The Service is offered in three tiers:
- Free: Core habit/goal tracking, basic analytics, and data source connections.
- Pro: Extended analytics, longevity scoring, training insights, self-comparison, and data export.
- Premium: All Pro features plus AI-powered weekly synthesis reports.
Feature availability within each tier may change as we develop the Service. We will provide reasonable notice of changes that materially reduce the functionality of a paid tier during an active subscription period.
5.2 Payments and billing
- Paid subscriptions are billed in advance on a recurring basis (monthly or annually, as selected).
- All fees are stated inclusive of applicable taxes unless otherwise indicated.
- We may change pricing with at least 30 days' notice. Price changes apply at the start of the next billing cycle after the notice period.
5.3 Cancellation and refunds
- You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
- We do not provide pro-rated refunds for partial periods, except where required by applicable law (including the EU Consumer Rights Directive right of withdrawal for the first 14 days of a new subscription, provided the service has not been fully performed with your prior express consent).
- Referral rewards (additional Pro days) are non-transferable, non-refundable, and subject to the programme's terms.
5.4 Free trials and promotional offers
We may offer free trials or promotional access from time to time (including via the referral programme). Trial terms will be communicated at the time of offer. At the end of a trial, your account will revert to the Free tier unless you subscribe to a paid plan.
6. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
- Provide false, misleading, or fraudulent information, including in challenges or shared content.
- Access or attempt to access another user's account or data without authorisation.
- Interfere with, disrupt, or overburden the Service's infrastructure, including through automated scraping, bots, or denial-of-service attacks.
- Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service.
- Use the Service to harass, abuse, threaten, or intimidate other users, including through challenges or shared content.
- Circumvent or manipulate subscription tier restrictions, referral programme rules, or rate limits.
- Use the Service to provide medical, clinical, or professional health advice to third parties.
- Redistribute, resell, or commercially exploit the Service or its outputs without our prior written consent.
- Upload or transmit malicious code, viruses, or any other harmful technology.
We reserve the right to suspend or terminate your access for violations of these Terms, with notice where practicable. For severe violations (e.g., security threats, fraud), we may act immediately without prior notice.
7. Third-party integrations and services
7.1 Connected data sources
The Service allows you to connect third-party services (Garmin, Strava, Apple Health, and potentially others in the future). Your use of these third-party services is governed by their respective terms of service and privacy policies, which you should review before connecting. We are not responsible for the availability, accuracy, or security of third-party services.
7.2 Data accuracy
Data imported from third-party sources is provided "as received." We do not guarantee the accuracy, completeness, or reliability of data from connected devices or services. Sensor inaccuracies, sync delays, firmware issues, and other factors beyond our control may affect the data. Longevity scores and analytics derived from this data inherit these limitations.
7.3 Third-party availability
We do not control third-party APIs and cannot guarantee their continued availability. If a third-party service changes, restricts, or discontinues its API, certain features of North that depend on that integration may be degraded or unavailable. This does not constitute a breach of these Terms.
7.4 Strava attribution
Activity data imported from Strava is provided in compliance with the Strava API Agreement. Strava and the Strava logo are registered trademarks of Strava, Inc. North is not endorsed by or affiliated with Strava, Inc.
7.5 Apple Health
Data from Apple Health is accessed via Apple's HealthKit framework on your iOS device. In accordance with Apple's requirements, health data accessed via HealthKit is never used for advertising, is not sold to third parties, and is not disclosed to third parties for purposes unrelated to providing the Service.
7.6 AI provider
AI-powered features use Anthropic's Claude API. Anthropic acts as a data processor. Under Anthropic's API terms, data sent via their API is not used to train their models. For details on what data is sent, see Section 4 of our Privacy Notice.
8. Your content and data
8.1 Ownership
You retain ownership of all content you create or import into the Service (habit names, goal descriptions, notes, imported health data, etc.). We do not claim ownership of your content.
8.2 Licence to us
By using the Service, you grant us a limited, non-exclusive, royalty-free licence to process, store, display, and transmit your content solely for the purpose of providing and improving the Service. This licence terminates when you delete your content or your account.
8.3 Shared content
When you use the sharing feature, you grant us permission to make the shared content publicly accessible via the generated share link for the duration of the share token's validity (up to 90 days, or until revoked). Shared content is anonymous by default. If you opt to display your first name, you do so voluntarily. You are responsible for the content you choose to share.
8.4 Data portability and export
You can export your data at any time in machine-readable format (JSON, CSV) via the in-app export features. See our Privacy Notice for details on data access and portability rights.
8.5 Backup and data loss
While we implement reasonable measures to protect your data (including encryption and regular backups), we do not guarantee against data loss. You are encouraged to use the export feature to maintain your own copies. We are not liable for any loss or corruption of data except where caused by our gross negligence or wilful misconduct.
9. Intellectual property
- The Service, including its design, code, algorithms, scoring models, branding, and documentation, is the intellectual property of VIGILANT FRONT, S.L. and is protected by applicable copyright, trademark, and other intellectual property laws.
- The North name, logo, and compass mark are trademarks of VIGILANT FRONT, S.L.. You may not use them without our prior written consent.
- These Terms do not grant you any right, title, or interest in the Service beyond the limited right to use it in accordance with these Terms.
10. Disclaimers of warranties
To the maximum extent permitted by applicable law:
- The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and quiet enjoyment.
- We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components.
- We do not warrant the accuracy, reliability, or completeness of any data, scores, metrics, insights, or AI-generated content provided by the Service.
- We do not warrant that longevity scores, training analytics, or any other outputs reflect your actual health status, fitness level, or medical condition.
- We do not warrant the accuracy of data received from third-party integrations (Garmin, Strava, Apple Health).
- No advice or information, whether oral or written, obtained from the Service shall create any warranty not expressly stated in these Terms.
Some jurisdictions do not allow the exclusion of certain warranties. In such jurisdictions, the above exclusions apply to the fullest extent permitted by law. Nothing in these Terms affects your statutory rights as a consumer under applicable mandatory law.
11. Limitation of liability
11.1 Exclusion of indirect damages
To the maximum extent permitted by applicable law, in no event shall VIGILANT FRONT, S.L., its directors, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, revenue, goodwill, data, or other intangible losses, regardless of the legal theory and even if we have been advised of the possibility of such damages.
11.2 Specific exclusions
Without limiting the generality of the above, we are not liable for:
- Any health outcome, injury, illness, or adverse event arising from your reliance on information provided by the Service, including longevity scores, training metrics, AI summaries, or any other output.
- Any decision you make based on data, scores, or insights provided by the Service.
- Any inaccuracy in data received from third-party integrations (Garmin, Strava, Apple Health).
- Any unavailability, modification, or discontinuation of third-party APIs or services.
- Any inaccuracy, error, or omission in AI-generated content.
- Any unauthorised access to your account resulting from your failure to maintain the confidentiality of your credentials.
- Any loss of data beyond what is recoverable from our standard backup procedures.
11.3 Aggregate liability cap
Our total aggregate liability for all claims arising out of or relating to these Terms or your use of the Service shall not exceed the greater of: (a) the amounts you have paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) fifty euros (EUR 50).
11.4 Exceptions
Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any liability that cannot be excluded or limited under applicable mandatory law, including your statutory consumer rights under EU or national law.
12. Indemnification
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless VIGILANT FRONT, S.L. and its directors, employees, and agents from and against any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from: (a) your use of the Service in violation of these Terms; (b) your violation of any applicable law; (c) your reliance on any output of the Service for health, medical, or fitness decisions; or (d) any content you share publicly through the Service. This indemnification obligation survives termination of your account.
13. Termination
- By you: You may delete your account at any time via the in-app account deletion feature. Account deletion is permanent and irrevocable. All associated data will be deleted in accordance with our Privacy Notice.
- By us: We may suspend or terminate your account for material breach of these Terms, with notice where practicable. For severe violations (security threats, fraud, illegal activity), we may act immediately.
- Effect of termination: Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including Sections 3, 8.2, 10, 11, 12, 15, and 16) will survive.
- Data after termination: We recommend exporting your data before deleting your account. After deletion, we cannot recover your data.
14. Service availability and modifications
- We aim to provide reliable access to the Service but do not guarantee 100% uptime. The Service may be temporarily unavailable for maintenance, updates, or circumstances beyond our control.
- We may modify, update, or discontinue features of the Service at any time. For material changes to paid features during an active subscription, we will provide reasonable notice.
- We reserve the right to discontinue the Service entirely with at least 60 days' notice, during which you can export your data.
15. Governing law and dispute resolution
15.1 Governing law
These Terms are governed by and construed in accordance with the laws of Spain, without regard to conflict-of-law principles. This choice of law does not deprive you of the protection afforded by mandatory provisions of the law of your country of habitual residence.
15.2 Dispute resolution
We encourage you to contact us first at privacy@gonorth.it to resolve any disputes informally. If a dispute cannot be resolved informally within 30 days, either party may commence proceedings.
15.3 Jurisdiction
Any disputes arising from these Terms shall be submitted to the courts of Madrid, Spain. However, if you are a consumer habitually resident in the EU, you retain the right to bring proceedings in the courts of your country of habitual residence, and you may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
16. General provisions
- Entire agreement: These Terms, together with our Privacy Notice, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements.
- Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it enforceable while preserving its intent.
- Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future.
- Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations in connection with a merger, acquisition, or sale of assets, provided the assignee agrees to honour these Terms.
- Force majeure: We are not liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, power outages, internet disruptions, or third-party service failures.
- No third-party beneficiaries: These Terms are between you and us. No third party has the right to enforce any provision of these Terms.
- Language: These Terms are drafted in English. In the event of a conflict between the English version and any translation, the English version prevails.
